property
We will provide you with helpful and independent advice in relation to
buying a home or investing in a second property. We are well aware that this can be a very
stressful time and are committed to providing as much assistance as possible as well as keeping you
up-to-date with the progress of your purchase. We will deal with the bank on your behalf and
ensure you are well aware of what is required to successfully complete your sale or purchase.
For first-time buyers we will explain the procedure to you, help you
figure out all your obligations (whether it is getting the snag list
done or what the previous owners are leaving in the house!) and answer

If you are moving into a property which is subject to a lease we can assist you by reviewing the
lease and letting you know what your rights and obligations are. Residential properties now require
a tenancy agreement to be signed by both sides so it is important that you read the document carefully
or have us take a look at it so you are clear what you can and cannot do at the property.
If you are a landlord, the Residential Tenancies Act, 2004 places a whole range of new obligations on you including the requirement to register a tenancy agreement. We can provide you with up-to-date advice in this regard and will be able to draft a tenancy agreement for your property. Check out some of these requirements in the June update on our News Page. Family Law
We can advise you of your legal rights and
and assist you should you be faced with the difficulties of a breakdown of a marriage. We can look after
your personal welfare as well as custody and access issues in relation to
the children. We do not
believe that family breakdown has to be an adversarial process and hope to assist in reaching an amicable
resolution for all the issues that arise in such a situation.
Wills and administering your estate
Everybody should have a will, but even more importantly anyone who owns any property, whether it is a
house or just an asset of some value, should make sure they have a will dealing with that property if
they die. Wills can be a simple one page document or as detailed as you want and we will be able to
assist you in preparing a will at a very reasonable cost.
If a loved one or someone close to you has died you may need help in administering their estate and dealing with the assets they leave behind. It can be a complicated process and often takes place when you least want to deal with such things. If you are an executor of an estate we can help you with your legal requirements and provide advice in administering the will. If a Grant of Probate is required we can prepare the application to the court and deal with transferring or selling a property if that is what's required. Criminal Law
We can act on your behalf in Court if you are faced with any criminal charges or driving offences.

you over the telephone or attend
with you at the Garda Station and will provide you with the best possible assistance in dealing with
the difficulties you face.
Accidents
In contentious business, such as personal injury claims, a solicitor may not calculate fees or other
charges as a percentage or proportion of any award or settlement and it is not our practice to do so.
If you have an accident or suffer an injury, whether it involves a motor vehicle or not, there are a range of new regulations involving the Personal Injury Assessment Board which you should be aware of. We can assist you in preparing a claim to go before the Personal Injuries Assessment Board and if needs be take the matter further and bring a claim to the courts. Suffering a personal injury or accident does not mean that the matter has to end up in court and we are aware that often the best result for you will be to resolve the claim by way of settlement or negotiation rather than have it drag out for years waiting for a result. Disputes and litigation
We have significant experience in the area of disputes and litigation and will be able to assist you in
resolving whatever difficulties you might be faced with. Whether you are facing a court action from
another party or have a dispute with someone that you want resolved, we can provide advice on your
options and the most economical way to deal with the mater. This could mean taking the matter to court
or finding some other way of resolving the dispute like mediation or arbitration. Whether it is a dispute
with your neighbour or a claim against a multi national corporation we can provide you with the right advice
to reach a suitable resolution.
Debt collection
If you are owed money for services you have provided or something you have sold or whether you are just
seeking a refund, we can provide you with advice on the best way to recover your money. We are realistic
with our advice about whether it is worth the time and cost to recover the money owed and can provide a
valuable service in recovering money often written-off.
Employment
No one should be forced to work under unreasonable conditions and you should be clear about your rights when
dealing with an employer. If you are having difficulties at work or have been dismissed unfairly, we can let
you know your rights and remedies under employment legislation. If you have been treated unfairly or
discriminated against in your workplace we can discuss
with you what options are available to you.
Commercial Clients Commercial Property/
Development Land
If you are looking to purchase property or develop a piece of Land, we can advise and assist
you on completing the transaction. You might have decided to take out a mortgage over your existing property
to raise capital for the business, to sub-divide the land for further development, or to purchase some
development land. We will be able to provide you with useful advice and assistance to carry out any of these
type of transactions in a cost effective way.
For Developers, we can discuss the best way of developing the land, either directly or along with a builder. we can cover all the leagl requirements, draw up a book of title and the contracts for the sale of the land to each purchaser. Taking on a new commercial lease brings with it a range of obligations and liabilities which you should
be fully aware of before committing to them. We can advise you prior to the signing of the lease and also
assist you with issues like rent reviews, renewing the lease, or assigning the lease to a new party.
If you own commercial property and intend to create an income by leasing the premises, we can
advise you on
the type of Lease best suited to the premises and provide a draft lease to suit.
If you are an existing Landlord having difficulties with your tenants. We can assist you in a range of matters concerning the Lease including recovering outstanding rent, dealing with breaches of the Lease or having the tenancy terminated. Litigation

We can advise you of your obligations should you have any employment issues or need advice in regards to your
employees. In this day and age you need to be well aware of your employees' rights (as they often are) and ensure
that you do not breach employment legislation when you deal with any issues that arise. Should the worst happen
and you be faced with an employment claim, we can advise you and represent you before the
Employment Tribunal or the Courts.
Starting up a business - Company formation
If you are thinking of starting up a new business often the best protection is to form a company with limited liability
to carry out the new venture. Or you may be an existing small business who is taking on bigger contracts
where it would be wise
to limit your personal liability by the formation of a company. We can assist you in setting up a company and advise you on
the advantages and disadvantages.
Partnerships
The type of business you wish to start up or develop may be best suited to operate as a partnership
between yourself and another person. The benefits of a partnership is that you spread the burden of
running the operation and share the legal liability (although don't avoid it) whilst avoiding some
of the tax burdens that come with a company. We can advise you on setting up a partnership and
provide you with the proper legal agreements to set up your partnership.
Expanding your business
If you have a small business, be it a company, partnership or a sole trader, we can advise you on the
best legal structures to expand your business. It may be to form a limited liability company for a new venture or expansion, to go into partnership with someone,
take on a new Franchise or build a network of distributors for your product, or protect your personal assets from business debts in some other way. Your existing business might be looking at purchasing commercial property, raising funds or taking on another lease for new premises. We can provide you with

Commercial Law
We can advise you on issues of company law that arise in the course of you business, whether you are a company director
looking to alter the structure of the company or a shareholder who feels their rights are being breached. We can advise
you on the role of directors and shareholders of a company as the position has changed somewhat over the last few years.
Directors are now be held more accountable for the operation of a company and as such need to take a much more involved
role in how the company is run.
Contracts Every business deals with commercial contracts whether they are simple invoices for products or more complicated commercial arrangements such as distribution agreements or sales and supply contracts.Businesses often overlook the need to review commercial contracts, no matter how straight forward, before any agreement is reached. Even reaching an "agreement on principle" can bind you into a commercial contract that may not be the most beneficial to you. You should seek advice before signing any contracts or even coming to an oral agreement which will tie you into a situation that is detrimental to your business. We can provide you with advice on the impact a commercial agreement will have on your business or draft appropriate contracts for you if you wish to regulate your dealings with another company or individual. |
